Terms of Use

To access SparkUp Academy, an adult parent or guardian must create a household account:

• Adult Responsibility: You must be at least 18 years old to create a household account and register payment methods. You are responsible for all actions taken by child profiles under your household account.
• Child Profiles: Parents can create profiles for their children (up to the limit allowed by their subscription plan). You must provide accurate but minimal information (e.g., first name/nickname, age).
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and password. Notify us immediately of any unauthorized access.

SparkUp Academy is a premium subscription service. We offer different tiers (Core and Pro) and billing intervals (monthly and annual).

• 14-Day Free Trial: We collect payment details upfront. The trial automatically converts to a paid subscription at the end of 14 days unless cancelled via the Parent Dashboard.
• Automatic Renewal: Subscriptions automatically renew at the start of each billing cycle (monthly or annual) using the payment method on file.
• Proration & Plan Changes: Upgrades from Core to Pro are calculated and charged immediately on a prorated basis. Downgrades take effect at the start of the next billing cycle.
• Additional Learners: Additional profiles can be added for $19/month per child. Adding a learner mid-cycle will result in a prorated fee.
• Cancellation: You can cancel at any time. Upon cancellation, you retain platform access until the end of your current paid billing period, with no further charges.

SparkUp Academy offers interactive AI-powered simulation modules (such as Failathon, Convince Me, and the Sparky AI guide).

• Educational AI Tool: Sparky and other AI guides are designed to simulate real-world thinking scenarios and prompt reflection. They do not represent human coaches or real-world legal, financial, or medical counselors.
• AI Response Boundaries: While we implement advanced moderation filters, AI outputs can occasionally be unpredictable. If your child encounters inappropriate outputs, please report them to support immediately.
• Ownership of Chat Logs: Chat logs are processed solely to drive the active scenario. By allowing your child to use the platform, you grant SparkUp a royalty-free license to process this content strictly for educational purposes and internal service improvement.

To maintain a safe and productive environment for all learners, you agree that you and your children will not:

• Input offensive, profane, abusive, or harassing content into Sparky or any simulation text fields.
• Attempt to reverse-engineer, scrape, copy, or bypass the security of SparkUp Academy's web services, APIs, or databases.
• Engage in chat "jailbreaking" or deliberate attempts to cause the AI tutor to output harmful or non-educational content.
• Impersonate other users or share household credentials with unauthorized individuals.

Violation of these rules may result in immediate suspension or termination of your household account without refund.

All materials, including curriculum designs, case study frameworks, graphics, software, code, branding assets (such as the Sparky mascot), and Thinking Tools (like First Principles Thinking guidelines, Systems Thinking workshops) are the exclusive intellectual property of SparkUp Academy.

Your subscription grants your family a limited, personal, non-exclusive, non-transferable, and revocable license to access the educational contents. You may not distribute, monetize, republish, or create derivative products from SparkUp curriculum elements without our explicit written consent.

SPARKUP ACADEMY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

While we strive to build high-quality, scientifically-backed educational frameworks, we do not guarantee specific academic, behavioral, or cognitive outcomes. We are not liable for any technical downtime, AI inaccuracies, or indirect damages arising from the use of our services.

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding related to the platform shall be brought exclusively in federal or state courts located in California.
